1. Introduction

These Terms & Conditions (“Terms”) govern all bookings and charter services provided by Hiatus Cruises LLC (“we,” “our,” or “us”). By booking a charter or using our services, you agree to these Terms.

2. Booking & Payment

A. Booking Confirmation

A charter is considered confirmed only when:

  • A deposit or full payment has been received
  • You receive written confirmation from us

B. Deposits & Final Payment

  • A deposit is required to secure your date
  • Remaining balances must be paid before departure
  • Payment instructions will be provided during booking

C. Accepted Payment Methods

We may accept:

  • Credit/debit cards
  • Online invoices
  • Other methods as communicated during booking

3. Cancellations & Refunds

A. Guest‑Initiated Cancellations

If you need to cancel:

  • Cancellations 7+ days before departure: Deposit refunded in full
  • Cancellations less than 7 days but 1+ day before departure: 50% refund
  • Cancellations within 24 hours of departure: no refund

B. Weather‑Related Cancellations

Safety is our top priority. If weather conditions make the charter unsafe:

  • The captain may cancel or reschedule at their discretion
  • Guests may receive a refund or credit if rescheduling is not possible

C. No‑shows: No refund

4. Safety & Conduct Onboard

A. Captain’s Authority

The captain has full authority over:

  • Navigation
  • Safety decisions
  • Passenger conduct
  • Weather‑related changes

All guests must follow the captain’s instructions at all times.

B. Alcohol & Behavior

  • Responsible alcohol consumption is permitted
  • Guests may bring their own beverages (no red wine).
  • Disorderly or unsafe behavior may result in early termination of the charter without refund

C. Prohibited Items

For safety reasons, the following are not allowed onboard:

  • Illegal substances
  • Weapons
  • Hazardous materials

D. Smoking & Vaping

Smoking and vaping are strictly prohibited onboard the vessel.

E. Pets

Pets are not permitted onboard unless approved in advance. Most pets do not enjoy boating, and this policy helps ensure a safe and comfortable experience for all guests.

5. Liability & Assumption of Risk

A. Inherent Risks

Boating involves inherent risks, including:

  • Slips and falls
  • Sudden vessel movement
  • Weather changes

By participating, you acknowledge and accept these risks.

B. Guest Responsibility

Guests are responsible for:

  • Their own safety
  • The safety of minors in their party
  • Any damage caused by negligence or misconduct

C. Limitation of Liability

Hiatus Cruises LLC is not liable for:

  • Personal injury resulting from guest negligence
  • Loss or damage to personal belongings
  • Events outside our reasonable control

6. Changes to Itinerary

Hiatus Cruises, LLC, reserves the right to adjust:

  • Routes
  • Timing
  • Destinations

These changes may occur due to weather, safety, or operational needs.

7. Photography & Media

We may take photos or videos during charters for promotional use, including on our website and social media.

Guests may be asked to sign a Photo Release & Media Waiver before boarding.

If you prefer not to be included in photos or videos, please notify us in advance so we can accommodate your request.

8. Personal Information

Your personal information is handled according to our Privacy & Cookie Policy, available on our website.

9. Governing Law

These Terms are governed by the laws of the State of Michigan.
